The present conditions of sale are concluded between the company TERROIRS S.A. (UNIVITIS’s online shop), with a share capital of €417,667, whose registered office is located at Les Lèves et Thoumeyragues – 33220, registered with the Registre du Commerce et des Sociétés de LIBOURNE – 33350 under number B388 976 110, hereinafter referred to as “TERROIRS S.A.” and managing orders placed via the site www.boutique.univitis.fr and by any person or entity wishing to make a purchase via the website www.boutique.univitis.fr hereinafter referred to as “the buyer.”
The purpose of these terms and conditions of sale is to define the contractual relationship between TERROIRS S.A. and the buyer and the conditions applicable to any purchase made via the website www.boutique.univitis.fr.
The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale which the buyer acknowledges having read prior to ordering. Before any transaction, the buyer declares that the purchase of products on the site www.boutique.univitis.fr is not directly related to their professional activity and is strictly limited to personal use.
TERROIRS S.A. reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. The applicable conditions will therefore be those in force at the date of the order by the buyer.
The products offered are those shown on the www.boutique.univitis.fr website of TERROIRS S.A. within the limits of available stocks. TERROIRS S.A. reserves the right to modify the range of products at any time.
Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible but are not binding on TERROIRS S.A.
The prices shown on the product sheets of the web catalogue are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.
TERROIRS S.A. reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased according to the total weight of the order.

Before placing an order, the buyer must create an account on the site www.boutique.univitis.fr. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if they wish to order or consult their account (status of orders, profile, etc.), must identify themselves using this information.
The company TERROIRS S.A. via the site www.boutique.univitis.fr offers the buyer the possibility to order and pay for products in several stages, with two payment options to choose from:
The buyer selects the products they wish to order in the “basket”, modifies, if necessary, quantities, references etc., and checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, as well as the name of the carrier.
The buyer then chooses the payment method of their choice: “Payment by credit card”. The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, and then confirm the order by clicking on the “Confirm my order” button.
Finally, the buyer is redirected to the secure interface of the LCL bank in order to enter their personal credit card details in complete security. If the payment is accepted, the order is recorded and the contract is definitively formed. According to article L. 132-2 of the French Monetary and Financial Code, the commitment to pay by credit card is irrevocable. The buyer confirms that he/she is the holder of the bank card to be debited.
The buyer selects the products they wish to order in the “basket”, modifies, if necessary, quantities, references etc., and checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, as well as the name of the carrier.
Then, the buyer chooses the payment method of their choice: “Payment by Paypal”. The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, and then to confirm the order by clicking on the “Confirm my order” button.
Finally, the buyer is redirected to the PAYPAL secure interface in order to safely enter their Paypal account details. If the payment is accepted, the order is recorded and the contract is definitively formed. According to article L. 132-2 of the French Monetary and Financial Code, the commitment to pay by credit card is irrevocable.
Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of having full knowledge of them and waiver of the right to invoke one’s own terms and conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the purchaser has an email address and if they have entered it on the order form, TERROIRS S.A. will send them an email confirming that their order has been registered.

The company TERROIRS S.A. retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.
Under Article L121-20 of the Consumer Code, the buyer has a period of 14 working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for return costs.
Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area, Metropolitan France only (for Corsica, please contact TERROIRS S.A. on 05.57.56.02.32). Deliveries are made by the carrier appointed by TERROIRS S.A.
Delivery times are approximately eight working days for a normal delivery route; if they exceed 30 days from the date of the order, the sales contract may be terminated and the buyer reimbursed.
The order is delivered to the place of delivery mentioned during the ordering process (see article 4). If the buyer is absent, they will receive a delivery notice with a telephone number to contact in order to make another appointment with the carrier to receive the goods. The buyer also has the option of choosing express delivery, which is also carried out by the carrier appointed by TERROIRS S.A.
The delivery time for the Express shipment varies between 24 hours and 72 hours on working days.
The buyer will have the option of having the order delivered to the location of his/her choice, as indicated on the order.
They will also have the choice of being delivered to a relay point, which they can choose when placing their order.
TERROIRS S.A. may provide the purchaser with information concerning the tracking of the package.
The risks associated with transport are borne by the purchaser from the moment the items leave the premises of TERROIRS S.A.
The purchaser is required to check the condition of the packaging and the contents of the goods on delivery in the presence of the Driver-Deliveryman.
In the event of damage during transport, any protest must be made to the Carrier on the delivery note issued by the Driver-Deliveryman and also by registered letter with acknowledgement of receipt, within three days of delivery. TERROIRS S.A. informs its purchasers that orders can only be processed and depart from our premises from Tuesday to Friday.
The carrier appointed by TERROIRS S.A. does not make deliveries on Saturdays, Sundays and public holidays. Similarly, for the period from 10 December to 10 January, delivery times may be longer, due to the high level of activity during this period. TERROIRS.SA. undertakes to do its utmost with regard to order preparation times, but remains dependent on the carrier appointed for delivery times during the period mentioned above.
All products supplied by TERROIRS S.A. are covered by the legal guarantee provided for in Articles 1641 et seq. of the Civil Code.
In the event of non-conformity of a product sold, it may be returned to TERROIRS S.A., which will take it back, exchange it or refund it.
All claims, requests for exchange or refund must be made within thirty days of delivery by post to the following address:

The company TERROIRS S.A., in the process of distance selling, is only bound by an obligation of means. It cannot be held responsible for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown of service, or other involuntary problems.
All the elements of the site www.boutique.univitis.fr are and remain the exclusive intellectual property of the company TERROIRS S.A. and the UNIVITIS cooperative. No one is authorised to reproduce, exploit or use in any way whatsoever, even partially, elements of the site, whether they be in the form of photos, logos, visuals, audio or text.
The company TERROIRS S.A. undertakes to preserve the confidentiality of information provided by the buyer, which he/she may be required to transmit for the use of certain services. Any information concerning him/her is subject to the provisions of law n° 78-17 of 6 January 1978.
